Agreeing to these terms

These Terms of Use are an agreement between you and PickStormm(“we”, “us”). By creating an account or using PickStormm, you agree to these terms, our Privacy Policy and our Community Guidelines. If you take part in monthly prizes, you also agree to the Official Rules. If you don't agree, don't use PickStormm.

The service

PickStormm is a free sports engagement service. It offers:

• Daily picks on real games, with win streaks and leaderboards
• Game rooms with live scores and chat
• Free fantasy contests with friends: Survivor, Pick'em, Pick 5, season leagues with a live draft, salary cap squads, golf One and Done and Five and Done, and volleyball season leagues
• Player stats and injury reports
• Sports news
• An AI analyst
• Monthly prizes

We may add, change or remove features at any time, and some features may not be available on every platform.

No gambling

Picks, stats, news and analysis, including the AI Analyst, are for entertainment and information only. They are not betting advice, and AI-generated content can be wrong. Don't use PickStormm to place, promote or arrange bets.

Eligibility and accounts

• You must be 18 or older and able to form a binding contract.
• One account per person.
• Give accurate information, including your real date of birth, and keep it up to date.
• You are responsible for keeping your sign-in details secure and for activity on your account. Tell us right away if you think someone else has used it.
• Don't use PickStormm where the law doesn't allow it.

Conduct

Follow the Community Guidelines. We have zero tolerance for objectionable content and abusive users. You must not:

• Post content that is harassing, hateful, threatening, sexual or illegal
• Impersonate anyone or share other people's personal information
• Spam, scam, or promote gambling or betting services
• Cheat, use more than one account, or manipulate picks, contests or leaderboards
• Use bots, scrapers or other automated tools to access the service
• Interfere with the service, or try to get around its security

We may remove content, and suspend or terminate accounts, that break these terms or the Community Guidelines.

Your content

You keep ownership of what you post, such as chat messages and your profile photo. By posting it, you give PickStormm a worldwide, non-exclusive, royalty-free license to host, store, display and distribute that content within the service, as needed to run PickStormm. You are responsible for what you post, and you confirm you have the right to post it.

Third-party and PickStormm content

Scores, stats, schedules, injury reports, team and league names and logos, player names, and news headlines and images belong to their owners. We show them for information. Showing them does not mean any team, league, player or publisher endorses or is connected with PickStormm. News stories may link to other websites that we don't control.

The PickStormm name, logo, apps and website belong to PickStormm. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial use under these terms.

Prizes

Monthly prizes are governed by the Official Rules. If the Official Rules and these terms conflict on anything to do with a prize, the Official Rules apply.

Service provided as is

PickStormm is provided “as is” and “as available”. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted or error-free, or that scores, stats, grading, news or analysis will always be accurate or on time.

Limitation of liability

To the fullest extent permitted by applicable law, PickStormmis not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of PickStormm. Our total liability for any claim relating to the service is limited to the amount you paid us to use the service in the 12 months before the claim, or the minimum amount applicable law allows, whichever is greater. Some places don't allow these limits, so they may not all apply to you.

Termination

You can stop using PickStormm and delete your account at any time. See how to delete your account.

We may suspend or end your access if you break these terms or the Community Guidelines, if the law requires it, or if we stop offering the service. Parts of these terms that by their nature should continue after termination, such as the disclaimers and limits of liability, will continue.

Apple App Store

If you downloaded PickStormm from Apple's App Store:

• These terms are between you and PickStormmonly. Apple Inc. (“Apple”) is not a party to them and is not responsible for the app or its content.
• Your license to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• To the maximum extent permitted by applicable law, Apple has no warranty obligation for the app.
• Apple is not responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy laws.
• Apple is not responsible for investigating, defending, settling or discharging any claim that the app or your use of it infringes a third party's intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

Changes to these terms

We may change these terms. The date at the top of this page shows when they last changed. If a change is material, we will announce it in the app. If you keep using PickStormm after a change takes effect, you accept the updated terms.
